Terms & Conditions
The contract is for a short-term holiday rental of the property called La Vieille Etable, made between the client and the owners of La Vieille Etable ("the owners"), Mark Howarth and Lindsay Howarth, binding from such time that booking is made and inclusive of all the following conditions. The property constitutes the house itself. The client may use the grounds including the lake at their own risk for the duration of the rental period.
The person who completes the booking, i.e. the lead name (“the client”) must be over 18 years and a member of the party occupying the property. The client contracts on behalf of himself/herself and all those in his/her party, and represents that he/she has the authority to accept these conditions on behalf of and binding upon all guests in his/her party. The client is responsible for any additional friends or family visiting the property while the client is staying there and must ensure their adherence to the conditions of the contract, including the rules and procedures contained in the information folder provided in the property.
Bookings are accepted on the understanding that the property is taken for holiday purposes only and that, excepting babies, the number of people residing in the property is limited to that entered on the booking form. The owners reserve the right to refuse admittance if this condition is not observed.
The Owners reserve the right to refuse or revoke any bookings from parties that may in their opinion (and at their sole discretion) be unsuitable for the property.
A deposit of 25% of the cost of the rental is payable on booking if the booking is made more than eight weeks before the start of the rental. Bookings are provisional until a deposit is received. Once a deposit has been received, the owners will issue a Confirmation of Booking. Once the owners have issued a Confirmation of Booking, the client is responsible for paying the total published price of the property and security deposit as shown on the confirmation. The Security Deposits will be cashed on receipt to allow for bank clearance and reimbursed promptly after the holiday (less any penalties which may be incurred). The balance shall be payable eight weeks before the commencement of the rental. On receipt of the Balance Payment, advice of key collection arrangements and directions to the property will be sent to the client. Non-payment of the balance of the rent on or after the due date may be construed as a cancellation of the contract by the client. The deposit paid on the booking will be non-returnable.
If the guest pays the full balance on time, they can receive:
a 50% refund of the total cost if they cancel at least eight weeks before check-in.
a 25% refund of the total cost if they cancel at least four weeks before check-in.
The client is strongly advised to take out holiday cancellation insurance.
The Hiring Contract is made on the understanding that the property and its facilities as published will be available for the dates stated. In the unlikely event that a property is not available through events arising outside the control of the Owner, then the Owner may be forced to cancel the booking. The client will be advised as early as possible and entitled to a full refund of all monies due. The client will not as a result have any further claims against the Owner.
Period of Hire
Rentals for the La Vieille Etable commence at 4.00 pm on the day of arrival and terminate at 10.00am on the day of departure. These times are non negotiable.
Right of Entry
Whilst respecting the reasonable privacy of the client, the owners of La Vieille Etable reserve the right to access the property at all times, if necessary, for repairs and emergencies.
Care of the Property
The client shall take all reasonable and proper care of the property and its furniture, fittings and effects in or on the property and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period.
Breakages or Damage
All damages and breakages are the legal responsibility the client, and should be notified to the owners before the end of your holiday so that matters can be rectified.
The client is bound to reimburse the owners for replacement, repair or extra cleaning costs where reasonably demanded by the owners for damage caused by the client. Normally, minor damage or breakages will not be charged but in circumstances where extra cleaning is required or there has been breakage or damage beyond what is reasonably to be expected, the owners reserve the right to charge the client for any additional costs incurred as a consequence
The owners or their employees have the right to enter the property (without prior notice if this is not practical or possible) if special circumstances or emergencies arise (for example if repairs need to be carried out). The Owners reserves the right to repossess the Holiday Home at any time, where you or any member of your party has caused damage. The Owners shall not be liable to make a refund of any remaining portion of the hire terms paid.
Rules and Procedures
Clients are required to observe the rules and familiarise themselves with the procedures contained in the information folder provided in the property.
Smoking is not permitted anywhere inside La Vieille Eable or near to the building.
A maximum of two dogs are permitted in La Vieille Etable subject to prior arrangement with the owners and the following conditions:
Dogs are not permitted upstairs or on the furniture. Dogs must not be left unattended in the cottage at any time.
When out of the cottage the dog must be under the control of a responsible adult at all times. The client must clear up after the dog promptly and dispose of bagged waste in an exterior bin.
The client is responsible for any damage howsoever caused by their dog and liable to reimburse the owner for any replacement or repair thereby necessitated. The owners reserve the right to terminate the contract if the behaviour of the client's dog is considered unacceptable.
The owners of La Vieille Etable are not liable for any loss or damage to any client's property or any property belonging to a member of the client's party howsoever caused.
The client or members of his/her party cannot hold the owners of La Vieille Etable liable for any personal injury/death howsoever sustained where the owners and/or their employees have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any member(s) of their party (including inadequate supervision of children); and/or where caused by the fault of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.
If the client is dissatisfied with the service you receive, The Owner must be notified immediately, so that investigation can be carried out and any necessary action taken. All complaints must be notified to the Agents immediately so that they can investigate the circumstances, and take any necessary action. In no circumstances can compensation be made for any complaints that are made after the hire has ended, or where the Hirer has denied the Agents or the Owners the opportunity to try to put matters right during the Hirer’s stay.
